Techflouu CRM - Terms of Service

1. Acceptance of Terms

By accessing or using the Techflouu CRM platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a binding legal agreement between you ("Customer" or "User") and Techflouu Pte. Ltd. ("Company", "we", "us"), a company incorporated in Singapore.

If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these terms.

2. Definitions

  • "Service" refers to the Techflouu CRM software, website, and related applications.
  • "Customer Data" refers to any data, information, or material provided or submitted by you to the Service.
  • "Subscription Plan" refers to the specific pricing tier (e.g., Starter, Professional, Enterprise) and associated components selected by the Customer in the Service Order.

3. Account Registration

Provisioning: Accounts are not available for self-registration. Access to the Service is provisioned by Techflouu personnel upon the execution of a binding Service Order or Quotation.

Credentials: You agree to not share your access credentials with unauthorized third parties. You are fully responsible for all activities that occur under your user accounts.

4. Subscription, Billing, and Refunds

Subscription Fees: The Service is billed on an Annual subscription basis. You agree to pay the fees applicable to your selected Subscription Plan as set forth in your Service Order.

Fee Components: Your invoice may include:

  • Software License Fees: Recurring annual fees for access to the platform.
  • Professional Service Fees: One-time fees for implementation, configuration, and data migration.
  • Training Fees: One-time fees for user or administrator training sessions.

Payment Terms: Unless otherwise stated in the Service Order, all invoices are due within 30 days of the invoice date.

Refund Policy: All fees paid are non-refundable. Because we incur costs for manual provisioning and implementation, we do not provide refunds for early termination, partial years, or "change of mind" after the Service has been provisioned.

5. Support Service Level Agreement (SLA)

We are committed to providing reliable support to ensure your success with Techflouu CRM.

Technical Support Hours: Our dedicated support team is available during standard business hours:

  • Hours: Monday to Friday: 9:00 AM to 6:00 PM (SGT)
  • Channels: Email
  • (Excluding Singapore Public Holidays)

24/7 Reachability: Customers may submit support tickets or inquiries 24/7 via email.

Response Times: We aim to acknowledge and begin working on critical issues within 4 hours during business hours. Non-critical inquiries are typically addressed within 1 business day.

6. Data Protection and Privacy

PDPA Compliance: We are committed to protecting your privacy and handling your data in accordance with the Personal Data Protection Act 2012 (PDPA) of Singapore.

Privacy Policy: Our collection and use of personal information in connection with the Service is described in our Privacy Policy, which is incorporated by reference into these Terms. By using the Service, you consent to the data practices described in our Privacy Policy.

Data Security: We implement industry-standard security measures (including TLS encryption for data in transit and AES-256 for data at rest) to protect your Customer Data. However, no method of transmission over the Internet is 100% secure.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Techflouu Pte. Ltd. and its licensors. The Service is protected by copyright, trademark, and other laws of Singapore and foreign countries.

8. Customer Obligations

You agree not to: (a) Use the Service for any unlawful purpose or in violation of any local, state, national, or international law. (b) Reverse engineer, decompile, disassemble, or attempt to discover the source code of the Service. (c) Sell, resell, license, or sublicense the Service to any third party without our prior written consent.

9. Termination

Contract Term: The initial term of this Agreement is 12 months (or as specified in your Service Order) commencing on the date of account provisioning.

Renewal: This Agreement will automatically renew for successive 12-month periods unless either party provides written notice of non-renewal at least 30 days prior to the end of the current term.

Termination Procedure: You may terminate your subscription by providing written notice via email to support@techflouu.com.

Effect of Termination: Upon termination, your right to use the Service will cease at the end of your current paid billing cycle. We will retain your data for a grace period of 30 days to allow for data export, after which your Customer Data may be permanently deleted in accordance with our retention policies.

10. Limitation of Liability

To the maximum extent permitted by law, in no event shall Techflouu Pte. Ltd. be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.
